Vaping is legal in Ireland, but the products and the way they are sold are regulated. This page gives adult customers the practical position as of 2 September 2026 without turning it into a law degree.
Quick answer: You must be 18 or over to buy vape products. Nicotine e-liquid is capped at 20mg/ml, nicotine refill bottles at 10ml and compliant tanks or pods at 2ml. Irish retailers also operate under licensing and advertising rules.
Age and Retail Licensing
Vape products cannot be sold to anyone under 18. Ireland’s annual retail licensing system for tobacco and nicotine-inhaling products came into operation on 2 February 2026, with a licence required for each premises in scope.
Product Limits
- Maximum nicotine concentration: 20mg/ml
- Maximum nicotine refill-container size: 10ml
- Maximum tank or pod capacity for regulated nicotine products: 2ml
Those limits come from the EU tobacco-products framework applied in Ireland. Zero-nicotine products can sit under different technical provisions, so avoid treating every bottle and device as legally identical.
E-Liquid Products Tax
EPT has applied since 1 November 2025 at €0.50 per millilitre. It covers both nicotine and non-nicotine e-liquid and is charged at the first supply in the State. Read Revenue’s current guidance.
Are Disposable Vapes Banned?
Not yet. The Public Health (Single-Use Vapes) Act 2026 commenced on 24 July 2026, but the Act provides a six-month transition for retail sales. A restriction is expected after that period, subject to the official rules and enforcement position then in force.
Are Vape Flavours Banned?
No general flavour ban is currently in force. The 2026 Amendment Bill proposes tighter controls on flavour names, packaging, advertising and display. A proposal or Bill is not the same as a commenced prohibition.
Where Can You Vape?
Premises, employers, transport operators and event organisers can set their own vaping rules. Check signs and ask if unsure. If somebody beside you is clearly not interested in your cloud, that is usually the answer too.
