Disposable vapes are not yet banned from retail sale in Ireland as of 2 September 2026. The Public Health (Single-Use Vapes) Act 2026 commenced on 24 July 2026 and provides a six-month transition for retail sales.
Current position: Sales remain permitted during the statutory transition. A retail restriction is expected after that period, subject to the official commencement, enforcement and guidance then in force.
What Has Already Happened?
The legislation was signed in July 2026 and the commencement order brought the Act into operation on 24 July. The Act itself includes transition wording for retail sales, so “the Act commenced” and “every retail sale stopped that day” are not the same claim.
What Counts as a Single-Use Vape?
The legal definition and official guidance control the answer. In general, the policy targets devices intended for one period of use rather than a durable device designed to keep using replacement consumables. Product labels such as “big puff”, “rechargeable” or “prefilled” do not decide the legal category on their own.
What Should Adult Customers Do?
